Court disposes of petition against "Pakhtunkhwa"

Wednesday, 15 July 2009 Peshawar: The Peshawar High Court on Tuesday disposed of a writ petition challenging the use of "Pakhtunkhwa" instead of NWFP by the provincial government. A two-member bench comprising Justice Dost Mohammad Khan and Justice Chulam Mohaiuddin Malik observed that the cause of action for the petitioner would arise when the government started using the term in its official correspondence. The bench observed that the petitioner could challenge the issue in future if he culd produce official documents wherein Pakhtunkhwa had been used in place of NWFP. The petition was filed by a leader of Pakistan Muslim League-Nawaz, Advocate Abdullah Sani. He stated that use of the term Pakhtunkhwa was unconstitutional. Mr. Sani requested the court to stop the government from using an unconstitutional name for the province. He claimed that the government had already renamed the Frontier Houses as Pakhtunkhwa Houses. He added that registration plates of various provincial departments vehicles referred to the province as Pakhtunkhwa instead of NWFP. He stated that several ministers were also referring to the province as Pakhtunkhwa in official statements. Mr. Sani argued that in the Constitution of 1973 the name used for this region was NWFP and unless an amendment had been made in the constitution the word Pakhtunkhwa could not replace NWFP. The bench pointed out that the president and prime minister had also been using the word Pakhtunkhwa but the petitioner had not challenged it. The petitioner stated that even they were using the term in unconstitutional manner. He added that when the government functionaries had been acting in unconstitutional manner then ordinary citizens should also be allowed to act against the law. The bench observed that the petition was filed prematurely.
